What types of personal information do we collect?

Personal Information we collect from you will depend on how you use the Website, whether you are a Registered User or just a visitor to the Website. Personal Information we collect from you may include your name, date of birth, image, email address, postal address, telephone number/s, credit card number and expiry date, debit card number and expiry date, bank account details, PayPal account details, Account passwords and usernames, information required for payment for products and services provided through the Website and information necessary for us to provide the Services to you. We will collect your name and email address if you wish to become a Registered User of the Website.

How do we use your personal information?

Payment card information

We may keep a record of your credit or debit card number if you pay us or any other person through the Website for products or services offered by the Website. We may not accept or permit direct payments to us, at our sole discretion. We will not keep a record of your credit or debit number if you pay for products or services via the secured third party payment service providers used by the Website, such as PayPal and eWAY.

Using 3rd parties to process your information or provide services

We may use third party companies (third party service providers) to manage information that you provide and we do use a secure third party service to process payments. Aside from the disclosure or transfer of your personal information to our Data Hosting Service Providers (see “Where your information is stored” below), when we use third party service providers, we seek to keep the amount of personal information they hold to a minimum and obviously use reasonable efforts to make sure they are as careful with your information as we are.

Where your information is stored

Subject to the below, personal information we collect from you is stored securely on servers in Australia. We also engage third party Data Hosting Service Providers to store and provide data hosting services in relation to your information. We will disclose Personal Information to our Data Hosting Service Providers to the extent necessary for them to provide the storage and data hosting services required for you to use the Website, Services and to post or purchase Creator Resources. Servers in which your information (including Personal Information) is stored by our Data Hosting Service Providers are currently located in Australia, although additional or other locations may be used by our Data Hosting Service Providers in the future. If our Data Hosting Service Providers store your Personal Information outside Australia, the Act requires us to ensure that our Data Hosting Service Providers comply with applicable Australian privacy laws unless you agree otherwise. By providing us with information (including Personal Information), registering an Account, using the Website, uploading Creator Resources or obtaining Materials or Services provided via the Website, you: (i) consent to us disclosing and transferring your information (including Personal Information) to our Data Hosting Service Providers; (ii) consent to our Data Hosting Service Providers storing your information (including Personal Information) on servers located outside of Australia; and (iii) agree that the requirement under the Act for us to ensure that our Data Hosting Service Providers comply with applicable Australian privacy laws in respect of your information (including Personal Information) does not apply if our Data Hosting Service Providers store Personal Information outside of Australia (as applicable). We may in the future store your Personal Information outside of Australia or engage other data hosting or storage providers that may store your Personal Information in or outside of Australia and will update this Privacy Policy if either is the case. We suggest that you visit our Website regularly to keep up to date with any changes.

Your rights of access and correction

You have the right to access Personal Information which we have collected from you within the requirements of the Act.

If you wish to access your Personal Information, or believe that any of the Personal Information we hold about you is inaccurate, incomplete or out-of-date, please contact us at the email address shown at the bottom of this Privacy Policy. We will take reasonable steps to correct any inaccurate, incomplete or out-of-date Personal Information if you request us to do so, where required by law.

Definitions

Unless otherwise defined in this Privacy Policy, words beginning with capital letters are defined in the Unbound Teaching Resources Website Terms & Conditions published on the Website as updated from time to time.

For the purposes of this Privacy Policy:

Data Hosting Service Providers means Global Switch Holdings Limited (and its related companies), Equinix Inc (and its related companies) and any other person or entity Gondwana may engage from time to time to provide similar or equivalent services; and

Personal Information means any information or data that you provide us in any form from time to time which relates to a living individual who can be identified from, or whose identity is apparent or can reasonably be ascertained from, that information or data alone or in conjunction with other information already held by the recipient, controller or processor of such information or data and includes any expression of opinion about the individual and any indication of the intentions of the recipient or any other person in respect of that individual.
